    Developments in Maryland and Federal Employment Law

    Presentation by Eric Paltell, Esq.

    This program will provide an overview of the changes in federal and Maryland employment law that have transpired in the past year, as well as predictions on what the coming year may bring. Areas to be covered  include legislative,  regulatory, and judicial developments, including Governor Hogan’s veto of the Healthy Working Families Act , what to expect from Congress and the Trump Administration with regard to executive orders, overtime regulations, and labor law reform, and important state and federal employment cases that have been decided by the courts in 2016 and 2017.

    Profile

    Eric Paltell has practiced law since 1987, concentrating in the representation of private and public sector employers in all aspects of labor and employment law. His clients include a broad range of businesses, including a regional health care system, a national mortgage company, a major automobile finance company, and numerous small to medium sized companies. Prior to joining Kollman & Saucier as a partner in 2002, he was a partner with one of the world’s largest law firms, Piper Rudnick (now known as DLA Piper). Eric’s practice includes general advice and counseling in employment matters, as well as the defense of employment discrimination and sexual harassment suits, ADA and FMLA litigation, wrongful discharge suits, wage and hour cases, ERISA litigation, NLRB proceedings, collective bargaining negotiations, and grievance arbitrations.

     

    Eric is a Fellow in the College of Labor and Employment Lawyers, and was named Baltimore’s Management Employment “Lawyer of the Year” by the Best Lawyers in America in 2014 and 2015.  Each year since 2003, Eric has been listed as one of the top labor attorneys in Maryland in the Chambers USA publication, “America’s Leading Business Lawyers,” and he is one of only six attorneys in Maryland to receive a “Band One” ranking from Chambers.  He has been listed by Baltimore Magazine as one of Maryland’s “Super Lawyers” since 2007, and been ranked one of the top 100 attorneys in Maryland since 2012. Eric has obtained an “AV” peer review rating from Lexis-Nexis/Martindale Hubbell and a perfect “10.0” rating from Avvo.

    Henry is a partner of Smith & Downey, a law firm with a national practice concentrating in employee benefits, executive compensation, and labor and employment law.  Smith & Downey has offices in Baltimore, New York, Washington, Charleston and Sarasota.

     

    Henry advises for-profit, tax-exempt, governmental and church-related employers of all sizes, in all industries and in all areas of the country, concerning the full range of employee benefit and executive compensation issues.  Henry also regularly works with other benefits professionals and other attorneys who require for their clients legal expertise in Henry=s practice area.

     

    Henry has been active in various American Bar Association and Maryland State Bar Association committees dealing with employee benefits and executive compensation, and he is a frequent lecturer and panelist at educational programs dealing with those areas.  Henry is past Chair of the Maryland State Bar Association's Employee Benefits Committee and past Chair of the Maryland State Bar Association's Tax Section.

     

    Henry is a principal author of Panel Publishers' Nonqualified Deferred Compensation Answer Book and Nonqualified Deferred Compensation Forms and Checklists, and formerly was a contributing author of Panel Publishers' 403(b) Answer Book.  From 1997-2000, Henry was the author of COBRA Procedures Manual, HIPAA Quarterly and COBRA Quarterly.  Henry also served as an Adjunct Professor of Law in the University of Baltimore Law School's Graduate Tax Program.

     

    Henry received his undergraduate degree, magna cum laude, from Frostburg State College, where he was an Honors graduate in Political Science and Education, received a Masters degree from the Johns Hopkins University, and received his law degree from the University of Maryland School of Law, where he graduated with Honors and was selected to the Order of the Coif.  Henry is a member of the Maryland and District of Columbia Bars.

    When not practicing law or spending time with his wife and five adult children and six grandchildren, Henry chairs the Surrattsville High School Foundation (www.surrattsville.org) and plays guitar in The Back Pages Band (www.thebackpagesband.com).

    Cases Studies on Recent Court Decisions:  How Recent Developments in the Law Will impact You as an HR Professional.

    Presentation by Tracey Eberling, Esq.

    I will present scenarios to the attendees based on issues decided on recent 3rd and 4th Circuit cases and some state law cases as well.  There will be interaction with the attendees to engage them in analysis and discussion of the points raised in the cases. This includes cases addressing employee speech (at work and after hours); Fitness for duty issues based on the sex of the employees; Hostile work environment based on race or sex; FMLA interference and Discipline of employee for support of others raising discrimination claims.

    BIOGRAPHY

    Tracey Eberling focuses her practice in the areas of labor and employment law and litigation, with a concentration in the defense of institutions, professionals, insurance companies and governmental entities. Ms. Eberling has tried numerous cases in the trial courts of Maryland and West Virginia, and has argued cases in the appellate courts of both states as well as the United States Court of Appeals for the Fourth Circuit.  She is a member of the firm's General Litigation group, the Professional Liability and Long Term Care group and the Education Law team.

    Jill is a partner in Barley Snyder's Labor and Employment Practice Group, where she counsels companies in handling workplace challenges and helps clients resolve disputes, claims, cases, and litigation in all aspects of labor and employment law.

    As an employment law counselor, Jill assists in developing employment policies, employee handbook provisions,non-compete and restrictive covenants and severance agreements, and has assisted companies through difficult layoffs and reductions in force. Jill serves as her clients' counselor-on-call, advising clients daily on a myriad of employment issues such as Internet and drug and alcohol abuse, evaluating requests for Family Medical Leave Act
    and military leaves of absence, questions under the Fair Labor Standards Act, using criminal background checks in hiring, conducting terminations, and other workplace challenges.

Examples of select matters which Jill has helped resolve for

    Served as trial counsel and successfully resolved a number of collective action wage and hour claims.
    Secured a complete defense verdict on claims of overtime violations of the Fair Labor Standards Act and breach
    of contract in the Lancaster County Court of Common Pleas.
    Served as co-trial counsel in the Eastern District of Pennsylvania on an ERISA claim for benefits in excess of a
    million dollars resulting in a complete defense victory for the company.
    Successfully defended a manufacturing client in a breach of employment contract claim in AAA arbitration.

    Successfully represented clients before the Unemployment Compensation Board of Review and the National
    Labor Relations Board in upholding the independent contractor status of their third-party contractors.
    Successfully defended a manufacturer before the American Arbitration Association, where the union alleged that
    the company violated the collective bargaining agreement, affirming the company's management rights in
    response to changing market needs.
    Represented a client in a jury trial in the Eastern District of Pennsylvania on an employment discrimination claim
    resulting in a defense verdict on five of six counts and a favorable resolution of the final count.
    Represented a client in a temporary restraining order/preliminary injunction involving claims of tortious
    interference with the company's contracts and misappropriation of confidential client information, involving over
    20 pre-trial motions and hearings, resolving the matter favorably for the client.
    Represented County Commissioners in interest arbitration regarding full-time and part-time Adult Probation
    Officers, Juvenile Probation Officers, BARJ Coordinator and Domestic Relations Hearing and Enforcement
    Officers under the auspices of the PLRB.

    Jill also defends Barley Snyder's food and agribusiness clients in matters ranging from class and collective action wage and hour litigation, whistleblower complaints, and employment discrimination claims, and provided counsel to companies on a wide range of employment practices and policies.
